This video is about the New York DWI refusal case and the two main penalties of that refusal. Refusals come in two forms: express and constructive (where the police feel your effort was inadequate). 

If you refuse the police request to give a sample of your breath, blood, or urine you will be marked as a DWI refusal. 

Your refusal triggers two main punishments: 

1) a license revocation of one year (and a hearing on that issue) and...

2)  a judge's instruction to a jury that the reason for your refusal was that you had a guilty conscious.
