Ithaca Cortland DWI lawyer explains VIOLATING the Ignition Interlock Device

When you can be VIOLATED by the Court 
with Ignition Interlock Device...

It is mandatory in New York that you get an Ignition Interlock Device on your car within 10 days of being sentenced for a Driving While Intoxicated offense (alcohol only).  

You will be required to have the IID installed and you will be required to pay for it.  Most local providers cost about $150 to install and $100 per month to monitor it.  

You can be VIOLATED for many reasons when the Ignition Interlock Device is put on your car...  

-if you have a Blood Alcohol Reading of 0.05% or more (you can be violated)
-if you fail to install the device within 10 days of sentencing
-if you fail to report monthly to the provider to download the readings

IF YOU DO BLOW MORE THAN 0.05% BAC, that does not mean you will automatically be violated...it is up to the COUNTY DWI MONITOR (in Tompkins County it is Michelle Barber) to decide whether to violate you and report you to the Court... 

The higher the BAC number, the more likely you will be violated.  

If you are reported to the Court, it is like having a whole new case against you...EXCEPT this time, the burden of proof is REDUCED from "beyond a reasonable doubt" to a civil standard ... "more likely than not."  That's very easy to prove.
