SAVING YOUR DRIVING PRIVILEGE
FOLLOWING A DWI ARREST
IN NEW YORK
This video is about a case we recently had in which we were able to compress a bunch of the legal proceeding and save someone's driver's license privileges. In this case, we had a self-employed plumber who needed his license to make house calls to people's homes with little notice.
In every New York State DWI case with a breath test, the court MUST suspend full driving privileges at the initial appearance. The judge can award a hardship license to drive "to and from" a job site or job, but nothing more than that. In this person's situation, he would have been out of a job,in essence, his driver's license was his livelihood.
If we could jump over this initial suspension then we could keep his privileges and he could get a conditional driver's license at the DMV about two weeks later. Conditional driver's licenses allow for driving for any work purposes.
In this case, he came to us early in the process. It allowed us time to get his police reports and documentation from the court, even before the DA got it. We were able to get his prior driving history and get him through an evaluation. All that meant preparing a complete package, and meeting with the DA to plea bargain.
Prior results on any case do not guarantee them on future cases. I can say without a doubt that assessing a case early and being proactive can lead to a better outcome overall.
